Question 2

Our legal system is based on case law and its interpretation. When laws are passed by Congress the law makers cannot predict the type and extent of cases that will result from the implementation and application of the law. In the employment area there are administrative agencies responsible for “regulating” and administering the law such as the Department of Labor, EEOC, OSHA, etc. but the application of the laws results in unanticipated issues arising over its application. This results in administrative complaints and law suits filed in our court system. As you can see from some of the cases that we have reviewed, even the different courts may have various interpretations over the application of the law. What impact and implications does this have for employers and Human Resources in particular and those individuals who are responsible for supervising employees in the workplace?

Question 3
